  This session highlights key compliance-related developments affecting cafeteria plans and health benefits over the past year. We'll review legislation, as well as regulatory and subregulatory guidance. The impacts of ongoing deregulation efforts at the agencies will also be addressed.
9:15 a.m. Benefits Litigation Update
  We will examine notable case law developments over the past year including the Eighth Circuit's decision addressing cross-plan offsetting, a trial court ruling that set aside key provisions of the 2018 associated health plan regulations, cases involving treatment exclusions and mental health parity, and additional decisions involving plan administration and claims issues.

10:45 a.m.   Wellness Programs: Practical Tips and Tricky Issues
  This challenging subset of benefits—encompassing educational programs, physical fitness encouragement, health questionnaires, biometric tests, and more—continues to be in the spotlight. We'll analyze the ever-evolving regulatory landscape, including the current status of the ADA and GINA incentive limits. Speakers will offer strategies for employers and service providers seeking compliance guidance amid uncertain legal standards.

1:45 p.m. Cafeteria Plans Panel: Expenses, Elections, and Nondiscrimination
  Panelists will respond to questions and scenarios submitted (in advance and live) by conference attendees and explain rules regarding health FSA and DCAP expense reimbursements; cafeteria plan elections and election changes; and nondiscrimination rules for cafeteria plans, health FSAs, and DCAPs.

3:45 p.m. HIPAA Privacy and Security: Lessons Learned From Recent Enforcement Activity
  OCR reached 10 resolution agreements and secured one civil monetary penalty in 2018. Phase 2 of OCR's compliance audit program has revealed significant compliance deficiencies. In addition, 12 state attorneys general joined to sue a HIPAA business associate for security rule violations. And HIPAA violations have led to civil lawsuits. We'll review the recent enforcement activity and identify some key lessons for group health plans, plan sponsors, and business associates.

8:30 a.m. Health Savings Accounts (HSAs): Hot Topics and Current Issues
  This session will address benefits that raise HSA eligibility issues (including flawed HDHP designs and incompatible coverage), as well as select issues in HSA design and implementation, such as contribution timing, fund offerings, and avoiding ERISA coverage. We will also discuss various mistakes in plan administration (e.g., contribution errors) and other legal risks.

  Are you prepared if the DOL comes knocking? In this session we will cover the DOL's enforcement authority and priorities, and explain the audit process including types of documents and information normally requested. And our speakers will offer practical tips to help you be prepared to present an effective response.

11:00 a.m. HRAs in 2020: A Brave New World for Defined Contribution Health Care
  This session will begin with a historical perspective on HRAs, including options and limitations for HRAs today, and will then focus on the agencies' final regulations for HRAs (issued in June 2019). Topics covered will include the two new types of HRAs, other aspects of the regulations, and related compliance issues. Action items will be discussed, including compliance and plan design decisions and other implementation issues.

1:45 p.m. Perspectives on Current Design Trends: Reference-Based Pricing, Ancillary Benefits, and Specialty Providers
  Our panel will explore recent design trends for various health and consumer-driven health care plans. Topics will include the implementation of reference-based pricing structures by plans, as well as recent trends in ancillary benefits and issues arising with specialty service providers.

  The consequences of failing to comply with employee benefit plan laws can include monetary penalties and litigation-related consequences potentially affecting the outcome of a lawsuit. We will provide practical examples demonstrating the consequences of a variety of plan-related errors.

8:30 a.m. Nuts and Bolts of HIPAA Uses and Disclosures
  In this session, we'll demystify HIPAA's detailed rules governing use and disclosure of protected health information (PHI) by group health plans, plan sponsors, and business associates. We'll review the definitions of covered entities and business associates and what is—and is not—PHI. We'll discuss uses and disclosures for payment and health care operations—along with special conditions for disclosures to plan sponsors. We'll conclude with uses and disclosures that require individual authorizations. Along the way, we'll explain how the rules apply to business associates.
9:45 a.m. What Is the GDPR and How Does It Affect U.S. Health Plans?
  The European Union's general data protection regulation (GDPR) took effect in May 2018 and is intended to have a broad scope. This session will include a discussion of the general requirements of GDPR, analysis of whether GDPR is applicable to sponsors and administrators of U.S. health plans, and a comparison of GDPR to HIPAA. We'll also review some best practices for compliance with GDPR and other data-privacy standards.

11:00 a.m. Top 10 Employee Benefit Pitfalls and How to Navigate Them
  We will wrap up the conference by highlighting some common pitfalls and offering practical advice on how to address them. Topics covered will include plan documentation issues, disclosure and communication problems, and group health plan compliance errors.
